An access request does not create an account or guarantee admission. A beta agreement begins when your access has been approved, you accept the applicable terms and your first sign-in succeeds. Accounts are intended for people aged 18 or over. If you act for an organisation, you must be authorised to do so.
A separately agreed contract takes precedence where it expressly provides otherwise. These terms do not govern hardware purchases or the separate movetrics.com website.
What the beta provides
Movetrics Cloud provides a hosted workspace for importing supported force-data exports, preserving originals, inspecting signals, running supported deterministic calculations and producing exports and reports. Available capabilities, requirements and limits are those shown for the beta and in the application.
The present invitation-only beta is free of charge. It does not start a paid subscription or automatically become one. Optional data reuse is not a condition of access. A future paid service requires a separate, explicit agreement on its price and terms.
The service requires an internet connection, a supported current web browser and cookies needed for secure sign-in. Not every CSV, Excel or C3D file can be interpreted. Missing or ambiguous metadata may require clarification or prevent a calculation. Preserve your original files outside the service.
Beta features can be incomplete, unavailable or interrupted for maintenance. No uninterrupted availability, universal vendor compatibility or permanent free hosting is promised. Mandatory duties concerning the quality, security and provision of a digital service remain unaffected.
Intended use and medical boundary
The beta is intended for non-medical performance observation, teaching, learning and research. Its calculations and visualisations help a user inspect a recording and document what it supports.
The service is not offered for diagnosis, prevention, monitoring, prediction, prognosis, treatment or alleviation of disease or injury. It must not be used to prescribe treatment, predict injury or clear a person to return to sport, work or another activity.
A report is not a medical assessment, a declaration that a person is safe to exercise, a certified normative ranking or proof of hardware accuracy. The beta has no claimed clinical validation or medical-device conformity assessment. Users remain responsible for qualified interpretation in the context of the original measurement and its limitations.
Check units, sample timing, calibration, coordinate systems, protocol and participant context before relying on a result. Do not remove uncertainty labels or present exploratory calculations as validated findings. A software disclaimer cannot make a medical use lawful where the service is not intended or suitable for it.
Accounts and lawful use
Keep account details accurate, protect access to your email account and do not share sign-in codes. Use workspace permissions rather than sharing another person’s account. Notify support@movetrics.com if you suspect unauthorised access.
Upload only material you are entitled to process. Minimise participant identifiers. If you upload for an organisation or about other people, establish the relevant authority, participant information, lawful basis and any required data-processing agreement first. Health and children’s data require additional safeguards; ordinary account acceptance does not supply them.
Do not attempt to access another workspace, bypass security or limits, introduce malicious files, disrupt the service or use it for unlawful purposes. Report suspected vulnerabilities privately to support and avoid accessing or copying other users’ data.
Permission to investigate one support case does not authorise permanent dataset reuse. Optional product-development permission is separate, revocable and limited as described in the Privacy policy.
Your files and outputs
You retain the rights you already have in uploaded material. Uploading does not transfer ownership to me. You grant only the rights needed to host, copy, process, display and return the material for the requested service and to use the necessary processors for those tasks.
You may download and use your own permitted exports and reports, subject to participant rights and any rights in source material. Keep source references, qualifications and limitations intact when sharing results. No rights are granted in someone else’s data.
The software, branding and service content remain protected by their applicable rights. These terms do not restrict rights that cannot lawfully be excluded, including applicable statutory software-use rights.
Athletes in a workspace can get a read-only copy of every recording of themselves in it, called My data. The copy covers recordings and results and does not include staff notes. A full access request goes to the organisation that runs the workspace, as controller. An athlete aged 18 or over can be invited to sign in and download it. For an athlete under 18, the invitation goes to a parent or guardian aged 18 or over, who signs in to see the copy. Recordings of minors need a separately agreed and lawful arrangement with the organisation that runs the workspace (see the Privacy policy).
AI features and connections
Two AI features exist: AI reads and explanations, and AI connections. In the beta every account can use AI reads, but nothing is sent until a person has agreed, and a workspace owner can switch all AI off for the workspace with “No AI in this workspace”. The core calculations, charts and reports use deterministic processing and do not depend on AI. Apart from AI apps you connect yourself, and Anthropic for AI reads and explanations, no AI provider receives Cloud data in the live beta. Descriptions of possible further AI features are plans, not a commitment that a feature is available or will be delivered.
AI reads and explanations. Each person agrees once, on a screen that says what is sent, before their first read, and can withdraw that agreement in Account at any time. A read then runs only when that person taps or asks for one, or, if the workspace owner turns it on, for each new recording under the owner’s agreement. An administrator can switch the feature off for a person and sets a monthly allowance for Think deeper, which runs on Claude Sonnet. When that allowance runs out, the Think deeper button stops until the next month, while included explanations, which run on Claude Haiku, continue. If the service-wide cap is reached, all built-in AI pauses until the next month. Nothing else changes, and no charge applies. Reads use Anthropic (Claude models) as their provider, which I chose. I may switch to another provider only after it is listed in the Privacy policy.
A read receives the athlete’s code, the results to be explained, such as jump height, the times of the movement phases, the force curve reduced to 25 values per second, the words typed to name the movement and, only where the workspace owner allows it, up to three recent notes on the athlete. It never receives the original file or the athlete’s name or date of birth from their record; typed text is cleaned automatically, but not completely (see the Privacy policy). Anthropic processes that data for me as a sub-processor in the United States, under its data-processing addendum, which incorporates the EU standard contractual clauses for that transfer, and deletes each request within 30 days unless its safety systems flag it. Explanations are saved with the result they explain and deleted with it. I do not use recordings to train a model through this feature, and Anthropic’s commercial terms say it may not train models on customer content from its services. Agreeing covers your own data only. It does not replace any information or consent that participants need, or a required data-processing agreement (see the Privacy policy). If you use AI reads on other people’s recordings, you are responsible for having a lawful basis and informing them.
AI connections. You may connect an AI app or provider of your choice to a workspace. When you do, you choose which workspace it can read and whether athlete names and file names are included; otherwise athletes appear as codes and file names are withheld. The AI receives only what it asks for, when it asks for it, at your instruction. I do not choose or pay that provider, and unlike AI reads it is not one of my processors. Its own terms and privacy notice apply to what it does with that data. Read access is the default. Changes an AI may make are off unless you allow them, are open only to roles that can change recordings, and are logged. You can undo a change unless the thing has changed again since, it has already been undone, or the recording has been in the trash for 30 days. A connection can move a recording to the trash, as your own “Move to trash” does, but it cannot erase one. Recordings in the trash are erased after 30 days. You can turn a connection off at any time in your Account. This does not give any AI provider permission to train a model on personal recordings.
AI output can be wrong and needs your review. It cannot establish missing physical facts or override measured data and verified calculations. AI features are not guaranteed to stay available, and they do not promise validated scientific or medical accuracy. The return-to-sport limit in Intended use and medical boundary applies to all AI output, including output from an AI you connect.
Ending access and exporting data
You may end your beta agreement at any time, without a fee, by emailing support@movetrics.com. You may also use account deletion where available. No paper letter or special wording is required. Export the material you wish to retain first.
I may end the beta or ordinary beta access with 30 days’ notice by email, allowing a reasonable opportunity to export accessible data. Immediate restriction or termination is possible for an important reason, including a serious breach, an urgent security threat or a legal requirement. Any action must be proportionate; reasons will be provided unless doing so would be unlawful or compromise security.
If a workspace has other members, ownership and their continued access must be resolved before automated owner-account deletion. This does not prevent you from ending your agreement or exercising statutory data rights. Support can help with the required arrangements.
Deletion, remaining shared records, necessary retention and provider copies are explained in the Privacy policy. Ending access does not grant a new right to reuse recordings.
Consumer rights and withdrawal
If you act as a consumer, your mandatory rights under German and applicable EU consumer law remain in place. A free service does not automatically exclude digital-service protections; they can also apply where personal data is supplied under the conditions set by law.
You may withdraw from this beta agreement within 14 days of its conclusion, without giving a reason. To do so, send an unambiguous statement to Marius Schober, Fasanenweg 6, 41564 Kaarst, Germany, or support@movetrics.com. Sending your statement before the period expires is sufficient. This free beta imposes no withdrawal charge. Your right to end the agreement at any time also remains available.
You may use the following wording, but are not required to: “I withdraw from my Movetrics Cloud beta agreement, concluded on [date]. Name: [name]. Account email: [email]. Address: [address]. Date: [date].” A signature is needed only if you send this form on paper.
A withdrawal ends the agreement. Processing and deletion of personal data remain subject to the GDPR and the Privacy policy. Nothing in these terms shortens a statutory withdrawal period or limits statutory remedies.
Liability
Liability is governed by applicable law. These terms do not exclude liability for intent, gross negligence, injury to life, body or health, fraudulent concealment, an expressly assumed guarantee, or liability that cannot be limited by law, including applicable product-liability and GDPR compensation rights.
The beta designation and intended-use limits describe the service and its evidential boundaries; they are not a blanket exclusion of responsibility. Statutory rights relating to defective or unprovided digital services remain unaffected.
Changes and applicable law
Material changes to the agreement will be explained before taking effect and require agreement where legally necessary. Silence alone does not constitute agreement. Changes to a digital service remain subject to any applicable statutory requirements. A new operator does not automatically replace Marius Schober as your contracting party merely because these pages change.
German law applies. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections that would otherwise apply. No exclusive place of jurisdiction is imposed on consumers.
If a provision is ineffective, the applicable statutory rules take its place. The remaining terms continue only to the extent permitted by law. Questions and complaints can be sent to support@movetrics.com.
